Court Reaffirms Order Against SON, Minister Over New Cement Grade

An Abuja Federal High Court on Tuesday reaffirmed its earlier order against the Standards Organisation of Nigeria (SON) and the Ministry of Industry over a newly-introduced cement grade in Nigeria.
The News Agency of Nigeria (NAN) recalls that Lafarge, a cement manufacturing company, had filed a suit against SON and the ministry over the enforcement of a new cement policy.
At the resumed sitting on Tuesday, Prof. Taiwo Osipitan (SAN), Counsel to Lafarge, had sought for time to respond to the fresh processes filed by the defendants.
However, Counsel to SON and the ministry, Mr Rickey Tarfa (SAN) and Mrs U. E Hassan-Baba, respectively opposed Osipitan’s submission.
They contended that Osipitan was being reluctant to proceed with the case.
In his ruling, Justice Ahmed Mohammed, refused SON and the ministry’s applications to set aside its earlier order.
Mohammed held that it was impossible for the court to proceed with the case without granting the plaintiff time to respond to the processes just served on it by the defendants.
The court had earlier declined granting an ex-parte application by Lafarge seeking to restrain the defendants from enforcing the new cement grade policy.
The court also insisted on the need for the defendants to appear and explain the rationale behind the newly introduced cement grade with which they now want cement manufacturers to comply.
Mohammed adjourned hearing in the case till  July 7. (NAN)
